Heard learned Counsel for the parties.

This Application is preferred by the defendant for condonation of 36 days delay in filing Appeal from Order.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

At the same time, applicant has to pay cost of Rs.750/- to the respondent within four weeks from Sneha Chavan 1/2

Hence, the following order:

i) Delay of 36 days in filing Appeal from Order is condoned.

ii) Applicant to pay cost of Rs.750/- to the respondents/their Advocate or to deposit in the Registry within four weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

iii) Interim relief, if any, granted earlier to continue for six weeks.

iv) Civil application stands disposed off accordingly.
