After this petition was heard for sometime, learned Counsel for the petitioner seeks leave to withdraw this petition with liberty to pursue appropriate proceedings to seek execution of the decree passed by the Small Causes Court at Mumbai, in RAE & R.Suit No.1108/3926 of 1990 dated 1st November 2001. Keeping open all contentions of the parties on merits, the petition is allowed to be withdrawn with liberty as prayed for.
