__________ CORAM : A. S. CHANDURKAR & JITENDRA JAIN, JJ.
DATE : 22nd MARCH 2024 P.C.:
1.
In all these Writ Petitions, the Petitioners have challenged the interim order dated 11th March 2024, passed in the respective Original
Applications before the Maharashtra Administrative Tribunal (for short "Tribunal").
2.
Mr. Dere, learned counsel for the Petitioners, on instructions, submits that pursuant to the impugned orders, the Petitioners have joined the place of transfer. He, however, submits that after the order dated 11th March 2024 was passed by the learned Member, the Tribunal at Aurangabad has decided Original Application No.240 of 2024 and has set aside the common transfer order dated 26th February 2024, insofar as the applicant therein is concerned. He, therefore, seeks leave to pursue the Original Applications before the Tribunal by bringing these facts on record.
3.
Since the Petitioners have joined at the place of transfer, it is not necessary to go into the correctness of the order dated 11th March 2024. Instead the following directions would serve the ends of justice:- (i) Each Petitioner is at liberty to file an Additional Affidavit and place on record subsequent events including the passing of the order dated 21st March 2024 by the Tribunal at Aurangabad.
(ii) The Respondents are also at liberty to file Additional Affidavits.
(iii)The Tribunal shall consider the Original Applications on
their own merits and decides the same expeditiously in accordance with law.
(iv)All points raised are kept open for being urged before the Tribunal.
(v) The Petitioners are at liberty to circulate the Original Applications prior to the next date of the proceedings. (vi)All the Writ Petitions are disposed of in the aforesaid terms.
