Heard the learned counsel for the Petitioner and the learned APP for the Respondent - State of Maharashtra. The petition is filed seeking direction to the respondent to take cognizance of his complaint dated 13th September, 2014. Copy of which is annexed at Exhibit-A. The learned APP placed on record report dated 8th May, 2015 of Amboli Police Station, Bombay. The statement of the proprietor of the complainant referred above and the conclusion has arrived at that the dispute between the parties are of civil nature. This decision is already communicated to the 1/2

wp-1464-15 petitioner. The report dated 8th May, 2015 is taken on record. In the above circumstances, the relief claimed in the petition will not survive. The petitioner is always at liberty to file private complaint before the concerned Magistrate. Subject to what is observed above, the petition is dismissed.
