By filing the present petition, the petitioner has made a grievance that the order dated 2.2.2017 passed by this Court in Writ Petition No.1360 of 2017 is not complied with. By the said order, Respondent No.2 was directed to consider and decide the proposal of the Headmaster of the Respondent No.4 regarding approval of the petitioner's appointment as expeditiously as possible

Mhi CP-494-17.doc preferably within four weeks from the date of receipt of copy of the order.

Mr. Kiran Lohar, Education Officer (Secondary), Zilla Parishad, Kolhapur, has filed an affidavit dated 7.3.2018. The affidavit discloses that by the order dated 3.3.2018, respondent No.1 has rejected the proposal of the Headmaster of the Respondent No.4. There is some delay. However, the explanation is given in the affidavit for the same which we found to be satisfactory.

In the light of above, the petitioner's remedy would be to challenge the order dated 3.3.2018 passed by the Respondent No.1 by filing appropriate proceedings. This contempt petition would not survive and the same is accordingly dismissed. [SMT. SADHANA S.JADHAV, J.] [RANJIT MORE,J.]
