1] Heard learned counsel for the Appellant and learned counsel for Respondent Nos.1,2, 3, 4B, 4C, 4D and 5. 2] It is submitted that the parties have arrived at mutual settlement and accordingly, the consent terms are reduced to writing and they are also 'Notarized' before the 'Notary'. 3] The original consent terms are produced on record. They are signed by all the parties and all the parties are also present before the Court. However, Respondent Nos.1 and 2 could not remain present 1/2
osk 3-sa-399-2018.odt because Respondent No.2 has undergone angiography and Respondent No.1 has sustained paralytic attack. Respondent Nos.1 and 2 have signed on the 'Consent Terms' in presence of their counsel and the Notary admitting the contents of the 'Consent Terms'. 4] All other parties present before the Court also admitted the contents of the 'Consent Terms', which are marked as Annexure - "A" for identification.
5] In view of the 'Consent Terms' (Annexure-A), the Second Appeal is disposed off.
