1] The applicant is apprehending arrest in connection with C.R. No.001 of 2019 dated 14/01/2019 registered with Ganeshpuri Police Station, Thane Rural, District Thane, for the offence punishable under Section 407 and 411 read with 34 of the Indian Penal Code. 2] Heard the learned counsel for the applicant and the learned APP for the respondent-State. Perused the record of investigation. 1/2

osk 911-aba-750-2019.odt 3] The allegation against the applicant is that he was to receive stolen property i.e. 500 kg of iron rods from co-accused Anil Kumar Singh who was entrusted with the said iron rods i.e. the said goods for transportation by M/s.S.S. Transport Company. The record indicates the applicant did not receive the said goods and the said goods were found lying on a road.

4] In view of the above, the applicant can be protected by prearrest bail. Hence, following order.

(i) In the event of arrest in C.R. No.001 of 2019 dated 14/01/2019 registered with Ganeshpuri Police Station, Thane Rural, District Thane, the applicant shall be released on bail on his furnishing PR bond in the sum of Rs.15,000/-, with one or two local sureties in the like amount.

(ii) Applicant shall not tamper with the evidence and/or interfere with the process of investigation.
