This Civil Application is for setting aside a self operative order of dismissal passed in the second appeal for non-removal of office objections and restoration of the second appeal on file. There is a long delay. On 14 August 2020, when the interim application was called out, learned Counsel for the contesting parties sought time to file a reply. Despite court granting time and standing over the matter, no reply has been filed. On the next date, i.e. 18 October 2020, none appeared for the Respondents; the Interim Application was, accordingly, stood over with a view to give one last opportunity
Chittewan 2/2 13.S.A. 887-2006.doc to the Respondents to contest the same. The matter thereafter appeared on 25 September 2020, but was adjourned to today's date. None appears today on behalf of the contesting Respondents. There is no reply on record. The Interim Application is, in the premises, allowed by setting aside the self operative order of dismissal and restoring the Second Appeal on file.
