Heard the learned counsel for the Applicant.

This Application is for condonation of delay in filing the First Appeal.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, following order is passed:
a) Rule.
b) Rule made returnable on 2.2.2018.
c) In addition to usual mode of service, Applicant is permitted to serve Respondents along 2 / 3
with entire proceedings by private notice either by registered post A.D. and/or by hand delivery and file Affidavit of Service to that effect.
d) Stand over to 2.2.2018.
e) Later on, advocate for the Applicant submits that Applicant is present in court. He submits that Applicant wants to withdraw the Civil Application as well as Family Court Appeal. She submits that to that effect, Applicant has written a letter/application dated 12.1.2018 duly certified by advocate for Applicant. Same is taken on record and marked 'X' for identification.
f) Same is accepted.
g) Hence, earlier order is recalled.
h) Civil Application as well as Family Court Appeal stands disposed of as withdrawn.
i) No order as to costs.
