The present Appeal, which assail the order passed by the Civil Judge Senior Division, Panvel on 04.04.2022 below Exh.27 can be conveniently disposed of by the following consensus arrived in the parties.

"(i).

Exhibit 5 which is pending before the Civil Judge shall be taken up for hearing as per its scheduled date, i.e. on 22.04.2022, upon reply being filed by the defendants.

2/2 29 ao 364-22=.doc (ii) Notice of motion shall be taken up for hearing by the learned Judge forthwith and in any case, it shall be disposed of on or before 30.04.2022.

Needless to state that both the parties shall render their co-operation to the learned Judge in disposing of Exh. 5.

(iii) The order dated 04.04.2022 shall continue to govern the parties till Exh.5 is decided."
