By this Petition under Article 227 of the Constitution of India, original defendant No.1 has challenged the judgment and order dated 02.04.2015 below exhibit-54 in Regular Civil Suit No.44 of 2015 passed by the learned 3rd Joint Civil Judge, Junior Division, Pandharpur. By that order, the learned trial Judge allowed the application made by the respondent - plaintiff under Order XXVI, Rule 9 of the Code of Civil Procedure, 1908 (for short 'C.P.C.') and appointed Taluka City Survey Officer as Court Commissioner.

Mr. Joshi, upon taking instructions from the petitioner, states that the petitioner is not pressing this Petition. 4.
