This Petition is filed under section 11 of the Arbitration and Conciliation Act, 1996 for appointment of Arbitrator. The prayer clause in the Petition reads as under:

"This honourable court may appoint Mr. J.G.Pendse as the Petitioner's arbitrator and direct the respondent to appoint his Arbitrator and upon his failure to do so, direct the Arbitration shall be conducted by Shri J.G. Pendse as sole Arbitrator." Learned Counsel for the Respondent on instructions states that the Respondent is agreeable to the appointment of Mr. J.G. Pendse as the Arbitrator.

In the circumstances, Mr. J.G. Pendse, IRS (Retd.) residing at Bhagirathi, Appu Ghar Road, Pradhikaran, Pune 411 044 is appointed 1/2
