This Criminal Application is moved by the applicant/accused for bail and suspension of the impugned judgment and sentence pending revision. By order dated 7.3.2014 passed by the learned J.M.F.C., Roha in R.C.C. No.48 of 2013, the applicant was sentenced to a maximum sentence of 2 years RI. Criminal Appeal No.23 of 2014 was preferred challenging the said order whereby the appeal was partly allowed by the learned Additional Sessions Judge, Mangaon, District Raigad vide order dated 19.3.2019 and though the conviction was maintained, the maximum sentence of 2 years was reduced to 6 months RI.

The learned Counsel for the applicant/accused submits that the applicant/accused has a good case on merits. Further, the applicant/accused was on bail throughout the trial and also during the appeal until he was taken into custody on 19.3.2019.

Learned Prosecutor is present and submits to the orders of the Court.

In view of the submissions of the learned Counsel and also as there is no chance that the Revision Application will be heard in near future, the application is allowed on the following terms: i) The applicant/accused shall be released on bail upon furnishing a P.R. Bond in the sum of Rs.15,000/- with one or two sureties in the like amount;

ii) The applicant/accused shall make himself available on all the Court dates.

Issue notice to the respondents in the Criminal Revision Application, returnable on 8.7.2019.

Criminal Application stands disposed of accordingly. 7.
