Heard learned counsel for the applicant and learned A.P.P. for the State.

The applicant is facing trial for the offences punishable under sections 7(i) read with Sections 2(ia)(a), 2(ia)(b) and 2(ia)(m) and section 7(v) read with Rule 44AAA punishable under sections 16 and 17 of the Prevention of Food Adulteration Act, 1954 in the court of Judicial Magistrate, First Class, Pune. His passport has expired. He wants to renew his passport. I do not think there should any impediment in granting such prayer. In so far

2appp335.2015.sxw as permission for travel out of India is concerned, he may apply separately after renewal of the passport.

For the time being, he is directed that he may submit his passport for renewal before the concerned passport authority and the passport authority may renew the passport in accordance with law. As far as period of renewal is concerned, this court has nothing to do with the said issue. The passport authority is at liberty to decide the same in accordance with the guidelines issued by the department. The order of this court will not come in the way of passport authority if the passport is renewed for the period of ten years.
