P.C. :- There is delay of 61 days in instituting the appeal. There is the cause shown in the application. Besides, learned counsel for the appellant has submitted that in the appeal only one point arises namely as to whether there was any breach of terms and conditions of the Insurance Company and therefore, the appellant-Insurance Company was not at all liable to pay any compensation as determined by the Motor Accident Claims Tribunal (MACT) Kalyan. She submitted that the appeal itself can be taken up for final disposal. Accordingly, delay in institution of the appeal is condoned. The civil application is disposed of.
