2) Civil Application is filed for following reliefs:- (a) That this Hon'ble Court be pleased to pass the order for hearing of appeal expeditiously and to list the appeal for final hearing as early as possible. (b) That this Hon'ble Court be pleased to pass the order of vacating the stay granted to the respondent by its order dated 11th February 2015.
(c) That this Hon'ble Court be pleased to direct the 1/3
respondent husband to pay Rs.15,000/- per month towards monthly maintenance from today and to clear the arrears/difference as per the calculation of Rs.7500/- per month from April, 2010 onwards till today till the final hearing and final disposal of the present Family Court Appeal.
(d) Ad interim relief in terms of prayer clause (a), (b), & (c).
(e) |For such further and other reliefs as the nature and circumstances of the case may require.
3) Learned counsel for the respondent upon instructions makes a statement that arrears of the maintenance are already paid to the applicant-wife and the respondent husband is depositing the maintenance amount regularly in the bank account of the applicant-wife. Statement is accepted.
4) The appeal is pending since 2013 and considering the nature of the dispute between the parties, appeal deserves to be heard expeditiously. Registry is accordingly directed to place the above appeal for final hearing on the weekly board commencing from 21.9.2015. 5) Since we have fixed the appeal for final hearing, we are not 2/3
inclined to vacate the stay or increase the amount of maintenance at this stage.
6) Registry is directed to place FCA No.255 of 2013 along with FCA NO.22/2014 on the next date.
Civil Application is disposed of.
