Learned APP pointed out that the Applicant has directly approached this Court and has not approached the Special Court. He submitted that propriety demands that the Applicant first exhausts the remedy of approaching the Special Court. I am inclined to agree with learned APP. 2.

In this view of the matter, learned counsel for the Applicant seeks permission to withdraw this Application with liberty to approach the Special Court for the same reliefs. Deshmane(PS)

Permission is granted. The Application is allowed to be withdrawn with liberty to the Applicant to approach the Special Court for the same reliefs. If such an Application is filed, it shall be decided on its own merits in accordance with law. The Application is disposed of accordingly.
