The aforesaid petition is filed by the petitioner, seeking quashing of the FIR bearing C.R. No. 1018 of 2020 registered with Yavat Police Station, Daund, Pune, at the behest of the respondent no.2, for the alleged offence punishable under Section 420 read with 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that during the pendency of the aforesaid petition, charge-sheet has been filed in the said case. He submits that although charge-sheet is filed

bipin prithiani 43-wp-3892.21.doc against other accused, charge-sheet has not been filed as against the petitioner, as no evidence was found against him. Learned counsel for the petitioner has tendered a copy of the final report, evidencing the same.

In view of the aforesaid, learned counsel for the petitioner seeks leave to withdraw the petition.
