IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION CIVIL APPLICATION (STAMP) NO.10372 OF 2016 IN WRIT PETITION (STAMP) NO.931 OF 2014 Shri. Chandan Madhukar Pawar .. Applicant
Versus
Sau. Smitha Chandan Pawar .. Respondent Mr. S. S. Raut, for the Applicant.
CORAM : R.M. SAVANT, J.
DATE : 7th APRIL 2016 P.C.
1.
By order dated 28.01.2016 passed in the above Petition by a Learned Single Judge of this Court, the Petitioner was directed to deposit an amount of Rs.50,000/- on or before 04.02.2016. In terms of the said direction the Petitioner had furnished a cheque of the said amount drawn in the name of the Learned Registrar of this Court. However, the said cheque was returned as the office note indicates as the "drawers signature differed". The Petitioner has therefore filed the above Civil Application seeking unconditional apology as also for the Petitioner to be permitted to deposit Rs.50,000/- by way of Demand Draft drawn on the Pune People's Co-operative Bank Ltd., Pune dated 31.03.2016 for the said amount. In my BGP.
(905)-CAWST-10372-16.doc view, it would be just and proper to allow the above Civil Application, which is accordingly allowed in terms of prayer clause (b). The office is directed to accept the Demand Draft for the said amount of Rs.50,000/- drawn on the Pune People's Co-operative Bank Ltd., Pune. 2.
In so far as the Writ Petition is concerned, the returnable date is extended upto 21.04.2016. The ad-interim relief would continue to operate.
