Incident of alleged assault on person of Ex-Army Ofcer, had occurred on 26th February, 2021 at around 21 hours. Complaint suggests, that the applicant and the co-accused, in prosecution of Najeeb 1/2

9.ABA 1017-2021.doc common object assaulted the complainant repeatedly. Resultantly, Complainant sufered head injury over right frontal aspect; C.T. brain shows linear undisplaced fracture of the frontal bone on right side. 3.

In consideration of the facts of the case, accusations against the applicants, its gravity, nature of injury coupled with applicants' non availability for interrogation, since the registration of ofence, no case is made out for granting pre-arrest protection to the applicant in connection with Crime No.112/2021 registered with Manchar Police Station for the ofences punishable under Sections 307, 326, 232, 143, 147, 148, 149, 504, 506 of the Indian Penal Code. Application is rejected.
