This is an Application under section 438 of Cr.P.C. filed by the aforesaid Applicant apprehending his arrest in C.R.No.55/2021 registered with Ratnagiri City Police Station, Dist. Ratnagiri for offences punishable under sections 195-A and 506 of the Indian Penal Code. 2.

Heard learned counsel for the Applicant, learned APP for the State and learned counsel for Respondent No.2. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties.

The aforesaid crime was registered pursuant to the FIR lodged by the Complainant-Respondent No.2 who was the prosecution witness in 1/2

P.H. Jayani 12 ABA1024.2021.doc the case registered against the Applicant herein. The Respondent No.2 has stated that the Applicant herein had threatened her not to depose against him.

Considering the nature of the accusations, this Court by order dated 08/04/2021 had granted interim bail to the Applicant. Learned counsel for the Applicant states that the Applicant has already reported to the Investigating Officer and that he was interrogated. Learned counsel for the Applicant further states that charge sheet has already been filed and that the Applicant has already been released on regular bail.

In such circumstances, the Application is itself rendered infructuous. Hence, the same is disposed of as infructuous. Suffice it to say that the Applicant shall not interfere with the Complainant/Respondent No.2 in any manner.
