Heard learned Counsel Mr. Talekar for the appellant and Mr. Kamble for the respondent no.14. Though the other respondents are duly served, no one appeared on behalf of them, when the matter called out.

Office note shows that present Civil Application stands dismissed against respondent nos. 6, 7, 9, 10 and 13.

This application is preferred by defendant no.12 for condonation of 1 year and 330 days delay in filing Appeal from Order.

13 caa 553-14=.doc Considering the submissions made by learned counsel for the applicant and averments made in civil application particularly in paragraph 4, I am satisfied that applicant has made out the case for allowing the civil application.

Hence, civil application is allowed in terms of prayer clause (b), which reads thus:

"b) This Hon'ble Court be pleased to condoned the delay of 1 year 330 days in filing the Appeal from Order."

Office is directed to make appropriate noting in cause title of Appeal from Order that Appeal from Order stands dismissed against respondent nos.6, 7, 9, 10 and 13.
