With the consent of the learned counsel for the parties taken on board and heard The above Civil Application has been filed for seeking substituted service to be effected on the Respondent No.3 to the above Petition. The reasons why the recourse to substituted service under Order V Rule 20 of the Code of Civil Procedure is required to be taken are mentioned in the above Civil Application.

caw-10415.15 In so far as the above Petition is concerned, the office note indicates that the notice to the Respondent Nos. 2 to 5 was returned back on account of insufficient time. However, the learned counsel for the Petitioner states that the Respondent Nos.2, 4 and 5 have been served by private advocate's notice and the affidavit of service dated 18/3/2015 to that effect has been filed.

Hence accepting the reasons mentioned in the above Civil Application, the same is allowed. The Applicant/Petitioner to publish a notice in newspaper "Daily Thane Vaibhav" indicating that the notice is made returnable on 15/06/2015. After the said paper publication, the learned counsel for the Applicant/Petitioner to file an affidavit of service annexing thereto the paper publication. The above Civil Application is accordingly disposed of.

In so far as the above Writ Petition is concerned, the ad-interim reliefs, if any, to continue until the returnable date. [R.M.SAVANT, J] lgc
