Heard Mr. Sarda, learned Counsel for the Applicant and Mr. Mangaonkar, learned APP for the Respondent-State. 2.

This Interim Application is taken out for the modification of condition No.16(d) of Order dated 15th February 2024. 3.

Mr. Sarda, learned Counsel for the Applicant submitted that the offence in question is punishable under Sections 302, 120-B r/w. 34 of the Indian Penal Code, 1860 and it occurred within the jurisdiction of Lonikand Police Station, Pune. He submitted that as

the learned APP has urged the Court that if the Applicant is released on bail, then he be directed not to enter Pune and Satara districts, therefore the Applicant has given address of his relativeDilip Sable who resides at Aurangabad and therefore he is attending Waluj Police Station, District-Aurangabad. However, he submitted that as the family-life of said Dilip Sable is disturbed, the Applicant is intends to reside at Badlapur at the house of his relative-Mr Dnyaneshwar Thaksen Wagh, Shri Ji Nirvana, Katrap, Badlapur (East), District-Thane, Maharashtra - 421503 and he will attend the Badlapur (East) Police Station, District-Thane. He further submitted that as far as attendance is concerned, the Applicant was directed to attend Waluj Police Station, DistrictAurangabad twice in a week, instead of that, the Applicant be allowed to attend the Badlapur (East) Police Station, DistrictThane once in a week. 4.

Mr. Mangaonkar, learned APP strongly opposed the Application.

However, for the reasons set out in the Interim Application, the Applicant is allowed to reside at his relative's place i.e. C/o. Mr

Dnyaneshwar Thaksen Wagh, Shri Ji Nirvana, Katrap, Badlapur (East), District-Thane, Maharashtra - 421503 and the Applicant shall report to the Badlapur (East) Police Station, District-Thane once a week on Sunday between 11:00 a.m. to 1:00 p.m. till the conclusion of the trial. The Police Inspector of Badlapur (E) Police Station, District-Thane to communicate details thereof to the Investigating Officer.

Accordingly, clause No.(d) of paragraph No.16 of Order dated 15th February 2024 is modified as under:- '

(d) The Applicant shall report to the Badlapur (E) Police Station, District-Thane once a week on Sunday between 11:00 a.m. and 1:00 p.m. till the conclusion of trial. The Police Inspector of Badlapur (East) Police Station, District-Thane to communicate details thereof to the Investigating Officer.' 7.
