This Appeal is directed against the judgment and decree dated 17th February, 2014 passed by the learned Judge of the City Civil Court, Borivali Division, Dindoshi, Mumbai thereby partly decreeing S.C. Suit No. 991 of 2010. The respondent No. 1/plaintiff has filed the suit for restoration of possession under section 6 of the Specific Relief Act and it was decreed.

The record discloses that by order dated 28th March, 2016 this Court has recorded that the counsel for the appellants had made statement that respondent No. 1 has expired and he needs to confirm the information received. However, thereafter no steps were 1 / 2
