The claim of the Petitioners pertains to grant of pay-scale to the post of Assistant Librarian, which is occupied by the Petitioners in Senior College.

The contentions of the counsel for the Petitioners are SANJAY ASARAM MANDAWGAD that the pay-scale of the Petitioners is at much lower than that of the similar placed employees in the Secondary School. According to him, the representation preferred by the Petitioners, time and again are pending with the Government and, as such, the Government is required to be called on issue of being parity.

It is further claimed by the counsel for the Petitioners that the qualification which are required for the post of Assistant Librarian or such other similar post in the Senior College is identical to that of the post of librarian in the Secondary School. Apart from the above, he would urge that the recruitment process, the nature of duties discharging are also identical. That being so, there has to be a parity in the pay based on equal pay for equal work.

Having been considered the aforesaid submissions of the counsel for the Petitioners, what can be noticed is that the claim of the Petitioners is in relation to seeking parity in pay with that of librarian, who are working with Secondary Schools in the State. Any orders by this Court will resulting a creating unplanned financial burden on the State exchequer. 6.

In the aforesaid background, in our opinion, it will be appropriate to direct the Respondent No.1-State of Maharashtra to treat petition of the Petitioners as a representation and take decision on the same as expeditiously.
