Heard Mr.Vishwanath Patil, learned Counsel for the petitioners and Mr.Surel Shah, learned Counsel for the respondent, at length.

Writ Petition No.4369/2015 takes exception to the judgment and order dated 28.1.2015 passed by the learned 1 / 3

District Judge­1, Solapur in Misc. Civil Appeal No.142/2013. By that order, the learned District Judge partly allowed the appeal preferred by the plaintiff and set aside the trial Court's order dated 21.12.2012. The learned District Judge directed the parties to maintain status quo in respect of the suit property till final disposal of the suit.

Writ Petition No.4382/2015 takes exception to the judgment and order dated 28.1.2015 passed by the learned District Judge­1, Solapur in Misc. Civil Appeal No.124/2011. By that order, the learned District Judge partly allowed the appeal preferred by the plaintiff and set aside the trial Court's order dated 12.7.2011. The learned District Judge directed the parties to maintain status quo in respect of the suit property till final disposal of the suit.

After arguing the Petition for quite some time, learned Counsel for the parties state that by consent the impugned order may be maintained and the liberty may be given to the parties to apply for disposal of the suits in a time bound manner.

In view thereof, by consent of the parties, Petitions are 2 / 3

disposed of as not pressed with liberty to the parties to apply for disposal of the suits in a time bound manner. If such application/s is/are made, the learned trial Judge will consider the fact that petitioner No.1 is a Senior Citizen and depending upon pendency of the suits, will pass appropriate order expediting the suits. Order accordingly.
