Learned counsel for the Applicant states that the trial has commenced and three witnesses have been examined till date. In view of the statement made by the learned counsel for the Applicant, it is not necessary to consider the Application at this stage. It appears that the trial has already commenced and three witnesses have been examined till date. Considering the same, it is expected that the learned Judge shall decide the case as expeditiously as possible. If for no fault of the Applicant the trial does not conclude, the Applicant is granted liberty to file a fresh Application.
