DATED : 27th JUNE, 2022 P.C:- On 21/3/2022, the applicant who is an Advocate sought pre-arrest bail in C.R.No.1/2022 registered with Mulund police station for offence punishable u/s.353 of the IPC. Pertinent to note that the said crime was registered pursuant to the complaint lodged by a typist attached to Magistrate's court.

2/2 7 11 IA 1259-22 and 1897-22.doc While admitting him to bail, the Court recorded prima facie case in his favour and also the statement of the applicant that he shall not indulge into such activities. Considering the nature of the allegations, he was directed to be released on bail.

The applicant moved the application before this Court (IA No.1259/22) insisting that his statement shall be recorded by the concerned Court.

This Court confirmed the order on 21/3/2022, disposing off the Anticipatory Bail Application The learned counsel has once gain taken out another application, stating that his submission should be recorded. This Court has already clarified that if the Investigating Officer desire to interrogate the applicant, he shall be given 48 hours notice. As far as his apprehension, that he may not be permitted to appear before the concerned Court, it is to be noted that there is no embargo imposed upon him in not appearing before the Court.

With the aforesaid clarification, both the applications are disposed off.
