Heard learned Counsel for the parties.
After the matter is heard at some length, it is agreed between learned Counsel for the parties that the impugned order dated 1 April 2017 of the City Civil Court at Bombay, to the extent it rejects the prayer for ad-interim relief under sub-section 2 of Section 9A of the Civil Procedure Code, 1908 (the "Code"), is set aside and the Notice of Motion is remanded to the Court for a fresh consideration of ad-interim relief under sub-section 2 of Sub-section 9A of the Code in accordance with law. Appeal from Order is disposed of.
