This is an application under Section 438 of Code of Criminal Procedure for anticipatory bail.

The applicant is apprehending his arrest in Crime No.117 of 2023 registered at Jejuri Police Station, Pune for the ofences punishable under Sections 420, 408 and 466 of the Indian Penal Code.

The applicant was Secretary of Rakh Vividh Karyakari Sahakari Sasntha Maryadit, Rakh, Tal. Purandar, Dist. Pune. According to the prosecution, the applicant while working as Secretary of said Sanstha had misappropriated the amount of Rs.7,85,624/-.

The learned Counsel for the applicant submits that the applicant has not committed any crime. It is submitted that the applicant without prejudice to his rights has already deposited the Dinesh S. Sherla 1/2
11-aba-970-23.doc alleged amount of misappropriation with interest. The learned APP does not dispute the said fact.

Considering the overall facts and circumstances, I am inclined to release the applicant on anticipatory bail. In the result the following order is passed.
ORDER
A) The Anticipatory Bail Application is allowed. B) In the event of arrest of the applicant in C.R. No. 117 of 2023 registered at Jejuri Police Station, Pune for the ofences punishable under Sections 420, 408 and 466 of the Indian Penal Code, the applicant be released on bail on executing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount. C) The applicant shall attend the concerned police station as and when called by the Investigating Ofcer and shall cooperate in the investigation. [N.R.BORKAR, J.] Dinesh S. Sherla 2/2
