IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.6196 OF 2014 Dilip Moreshwar Chandgude and Anr.

...Petitioners

v/s.

Pune Municipal Corporation and Ors.

...Respondents.

--- Mr.Jaydeep Deo, for the Petitioners.

Mr.Abhijit P. Kulkarni, for the Respondent Nos.1 to 3. --- CORAM: A. S. OKA & REVATI MOHITE DERE, JJ.

DATED : 22nd JULY, 2015.

P.C.

1.

Heard the learned counsel appearing for the petitioners and the learned counsel appearing for the respondents. 2.

Admittedly the water supply which was granted to the premises in possession of the petitioners was not standing in the name of the petitioners. The said supply was for residential use. After disconnection of the said supply, the petitioners seem to have applied repeatedly for restoration of the said supply by offering to pay charges at the commercial rates.

2/2 41-wp.6196.2014 3.

Today, the first petitioner is in possession of the premises in question. Therefore, the first petitioner will have to make an application to the Municipal Corporation for grant of fresh water supply/connection to the premises. If such application is made by the first petitioner, the respondents shall decide the same in accordance with law as expeditiously as possible and preferably within a period of three months from the date of filing of the application. All contentions of the parties are kept open. 4.

The petition is accordingly disposed of.
