By an Order dated 23rd March 2019, the Applicants were granted interim relief.

Learned counsel for Applicants, on instructions submitted that, the Applicant No.1 husband and the first informant wife have settled the 1/3
Tandale 901-ABA-760-2019 a.w.APPP-616-2019.odt matter amicably and have filed a Petition for divorce by mutual consent as contemplated under Section 13-B of the Hindu Marriage Act, 1955 before the Family Court, Thane. He produced on record a photocopy of the said Petition bearing Registration No.247 of 2021.

Mr. Rahul Shelke, learned Advocate for the intervenor wife conceded to the said fact of filing of Petition for divorce by mutual consent interse between the parties. He, on instructions further submitted that, first informant has no objection for allowing the present Application by confirming interim relief.

Learned A.P.P., on instructions submitted that, it is a matter of fact that the Applicant No.1 and the first informant have settled the matter and have filed the aforestated Petition for divorce by mutual consent. Learned A.P.P. also produced on record a report duly signed by Shri Tanaji Rode, Assistant Police Inspector attached to Chitalsar Police Station, Thane, stating that, the investigation of the present crime is already completed and the Police have submitted charge-sheet in the matter.

Perusal of First Information Report would indicate that, the First Information Report has been filed by the informant-wife, basically arising out of matrimonial discord. As the parties herein have now settled the matter amicably, the interim relief granted by Order dated 28th March 2019 can be confirmed and is accordingly confirmed.

Application is allowed in the aforesaid terms. 7.
In view of disposal of the present Application, Criminal Application No.616 of 2019 filed by the intervenor, does not survive and is accordingly disposed off.
