After restoration of the aforesaid Petition, by a separate order passed today, with the consent of the parties, the aforesaid Petition is taken up for final admission. 2.

At the outset, the learned Counsel for the petitioner seeks leave to withdraw the petition with liberty to file an appropriate application before the trial Court, seeking discharge of the petitioner from the said case. Satish Sangar 1/2

Petition is accordingly disposed of as withdrawn with liberty as prayed.

If an application for discharge is filed, the learned Judge to decide the same on its own merits, uninfluenced by the withdrawal of this petition.

All contentions of the petitioner on merits are kept open.

It is made clear that the aforesaid order is passed having regard to the statement made by the learned Counsel for the petitioner that charge has not been framed in the said case till date.

Petition is disposed of accordingly.

8.

All the parties to act on the authenticated copy of this order.
