Heard the learned counsel for the parties.

By this Petition under Article 227 of Constitution of India, the petitioner plaintiff challenges the order dated 3.3.2014 passed by Adhoc District Judge-2 & Assistant Sessions Judge, Thane in Misc. Appeal No.228 of 2013 setting aside the order passed by Trial Court below Exhibit 5 in Regular Civil Suit No.726 of 2013 dated 23.10.2013 restraining the respondent Corporation from dispossessing the plaintiff from the suit building without following due process of law. The learned counsel for the Municipal Corporation submits that during the pendency of the present Writ Petition suit building is already Mohite 1/2

41 wp1537-15 demolished. Same is not disputed by the learned counsel for the petitioner.

Considering the subsequent development, nothing survives in the present Writ Petition. Writ Petition stands dismissed as infructuous. JUDGE Mohite 2/2
