Mr.Tripathi, learned counsel for the petitioner points out that Special Civil Suit No.279/2012 in which the impugned order was made has itself be settled and even the compromise decree is drawn. He places on record the order dated April 25, 2019 made by the learned trial Judge to the aforesaid effect.

In view of the aforesaid, the learned counsel for the petitioner, on the basis of instructions from the petitioner, seeks leave to withdraw the petition since the case is now settled. Leave as prayed for is granted. The petition is disposed of as withdrawn. (M.S.SONAK, J.)
