In the eventuality, they do not surrender, the Investigating Agency would be free to arrest the Applicants. The Learned Magistrate shall consider the application for bail under section 437 of the Criminal Procedure Code on merits without being influenced by the withdrawal of the present application under section 438 of Cr.P.C.
