Learned Advocates for the parties have tendered a copy of the Memorandum of Understanding (MOU) dated 01.10.2021 executed by and between (1) The Station Commander, Kirkee/Aundh (Local Military Authority), (2) The Senior General Manager, Ammunition Factory Khadaki, Pune - 411 003 & (3) Defence Estate Officer, Pune Circle, Pune - 411 001 (Party of the First Part) and the Pimpri Chinchwad Municipal Corporation, Pimpri, District Pune (Party of the Second Part). Under the said MOU, the Party of the First Part has agreed to accord working permission to the Party of the Second Party

CIVIL IA 1790-21.doc i.e Pimpri Chinchwad Municipal Corporation on Defence Land measuring 16,122.00 sq. mtrs. out of GLR Survey Nos. 1, 1-A, 29, 30, 1-D, 7, 15 & 7-A of Kirkee Cantonment, to Pimpri Chinchwad Municipal Corporation (PCMC) for construction of Bhopkhel bridge and approach road connecting Bhopkhel village through Kirkee Cantonment as per the terms and conditions mentioned therein. 2.

The copy of the MOU is taken on record and marked "X" for identification. The statement of the Party of the First Part as well as the Party of the Second Part made before us that they will act in accordance with the MOU is accepted as an undertaking given to the Court.

The Party of the First Part is directed to allow the Party of the Second Party to start the work as agreed under the MOU at the earliest. After getting permission, the Party of the Second Part shall complete the construction as early as possible. 4.
