None present on behalf of the Petitioner. On last two occasions, namely, on 28th July 2017 and 31st August 2017, also nobody appeared on behalf of the Petitioner. It appears that the Petitioner is not interested in prosecuting this petition.

That apart, affidavit filed by Vijay Jagtap, Senior Inspector of Police, Vartaknagar Police Station shows that the Commissioner of Police, Thane passed an order dated 30th January 2010 against Respondent No. 4 thereby directing deducting the amount equivalent to two increments from his salary for the period of one year. Respondent No. 4 filed appeal against the said order. However, in July 2017 Respondent No. 4 has retired from service. The learned Counsel for Respondent No. 4, on instructions, makes a statement that Respondent No. 4 has already suffered the punishment given by Commissioner of Police.
