On perusal of the material compiled in the charge-sheet, which accuses the Appellant of committing the offences punishable under Sections 302, 307, 354 read with Section 34 of the Indian Penal Code, Sections, 3(1)(r), 3(1)(s), 3(1)(w)(i) (ii) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 and Sections 8 and 12 of the Protection of Children from Sexual Offences Act, 2012, when I expressed my disinclination to entertain the Appeal, M.M.Salgaonkar

Permission granted. The Appeal stands disposed off, as withdrawn.

Taking into account that the Appellant is a young boy, aged 21 years, having no criminal antecedents, I request the Special Court to frame the charge within a period of one year from today and expedite the trial.

Before parting, I record the words of appreciation for Advocate Sushant Mhatre, who has effectively represented the cause of Respondent No.2 before this Court. The Legal Services Authority is directed to pay the legal remuneration due and payable to him, within a period of six weeks from today.
