Learned Senior Counsel after arguing for some time, upon instructions seeks liberty to withdraw the present Petition. Liberty as prayed for is granted in the interest of justice. Learned Counsel Mr. Adav waives service and submits that as on today bailable warrant has been issued against the petitioner since she has not caused appearance before the trial Court. 12.wp1543.17.sxw Senior Counsel upon instructions submits that in the eventuality, bailable warrant is issued, the Petitioner would appear before the Magistrate in person and file an appropriate application for recalling of the bailable warrant. The learned Senior Counsel submits upon instructions that the petitioner desires to file an application for exemption from appearing in the court, even at the time of recording of plea. The learned Magistrate shall consider the same on its own merits and decide the same expeditiously.

The Petition stands dismissed as withdrawn and disposed of accordingly.

Office to communicate this order to the concerned Metropolitan Magistrate, 33rd Court, Ballard Pier seized with C.C. No. 5960/SS/2015 forthwith.
