Applicant, a convict in prison has challenged the conviction under section 374 (2) of Code of Criminal Procedure, 1973. As there is delay of 33 days in filing the appeal, prayer is to condone it. The learned counsel for the applicant submits that applicant is in jail and hence could not take timely steps.
