This Miscellaneous Civil Application seeks re-transfer of Suit No.8991 of 1994, pending before the City Civil Court at Bombay (Original High Court Suit No.4162 of 1994) to this Court. The application is on the footing that the suit valuation exceeds the pecuniary jurisdiction of the City Civil Court. The subject matter of the suit is two flats at Bhulabhai Desai Road in Mumbai. There is reason to believe, going by the averments in the plaint that, valuation of these properties exceeds Rs. 1 crore. Anyway, there is an averment made in the Miscellaneous Civil Application that the value exceeds Rs.1 crore and there is no reply.

The Miscellaneous Civil Application is allowed in terms of prayer clause (a).
