The order passed by the Returning Officer rejecting the nomination of the Petitioner on the ground that the signature of the proposer has not been affixed to the nomination form is taken exception to by way of the above Writ Petition.

The learned counsel for the Petitioner states that the Petitioner has preferred an Appeal by taking recourse to Section 152(A) of the Maharashtra Co-operative Societies Act. If that be so there is no warrant to entertain the above Writ Petition as it would be in the Appeal that the correctness of the order passed by the Returning Officer would be decided. With the aforesaid observations, the above Writ Petition is dismissed. [R.M.SAVANT, J] lgc
