The Applicant is apprehending arrest in connection with CR No.I-83/2017 registered with Kalyan Taluka Police Station for offence under Sections 376 and 420 of Indian Penal Code. 2.
The prosecution case is that the Applicant and the complainant were having relationship and on the false promise of marriage, the Applicant-accused had established sexual relationship with the complainant. On perusal of the first information report it revealed that there was consensual relationship between the Applicant and the complainant.

Learned advocate for the Applicant submitted that the complainant was aged about 19 years at the time of offence. She further submitted that the Applicant has co-operated with the investigation and reported the Police Station as directed by this Court
2 of 2 20.ABA.611.2017 vide order dated 10th April 2017. It is further submitted that the mobile phone of the Applicant has been handed over to the investigating machinery.

Considering the aforesaid facts and circumstances, there is no necessity of custodial interrogation of the Applicant. Hence, I pass following order :
ORDER
(i) Anticipatory Bail Application is allowed;
(ii) Interim order dated 10th April 2017 is confirmed; (iii) The Applicant is directed to report Kalyan Taluka Police Station as and when called by the investigating officer; (iv) The application is disposed of.
