Heard the learned counsel for the applicant.
This application is filed under Order 5 Rule 20 of the Code of Civil Procedure, 1908 for substitute service on respondent no.1 by publication in newspaper.
Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order:
a) Applicant is permitted to serve respondent no.1 Mohite 1/2
17 caa651-15.doc as per Order 5 Rule 20 of the Code of Civil Procedure, 1908 by publishing in two newspapers having vide circulation in the area where respondent no.1 lastly was residing.
b) Returnable date after 16 weeks.
c) Civil application stands disposed off accordingly.
