The Petitioner by way of present Petition is seeking relief for setting aside the election of the Zilla Parishad. Efficacious remedy is provided under Maharashtra Zilla Paarishads and Panchayat Samitis Act, 1961.

Such dispute and questions of facts cannot be gone in Writ Petition. In any event the provisions of Act 243 ZG of

2 WP.6006/2017(924) Constitution of India itself provides that the election of the candidates elected to local authority can be challenged only by way of Election Petition.

No case for interference is made out. The Writ Petition is dismissed relegating the Petitioner to alternate remedy available in law.
