The learned Counsel appearing for the petitioner submits that the statement was made on 13th March, 2015 praying for dismissal of Civil Application No.2099/2014 as it had become infructuous but inadvertently the the Writ Petition No. 2949/2006 was shown to have been dismissed. 2.

The learned Counsel appearing for the petitioner submits that connected petition No.5326/2004 filed by Union of India against the

2/2 caw1068.15.sxw petitioner Rajendran is being heard by a co-ordinate Division Bench. The learned Counsel pray for restoration of the writ petition. 3.

The Counsel for Union of India had no objection if the petition is restored.

The order passed on 13th March, 2018 dismissing the writ petition is recalled. The Writ Petition No.2949/2006 is restored to file. 5.

The Civil Application No.2099/2014 is also restored to file and stands rejected as rendered infructuous.
