DATED : 3rd APRIL 2023 P.C:- On hearing the learned counsel Mr. Upadhyay, and learned APP in presence of the Investigating Officer, the learned APP make a statement that a notice dated 23/3/2023 shall be withdrawn. Since accepting the aforesaid statement, the criminal application stands disposed off.

As far as the prayer clause 'b' and 'c' of Mr. Upadhyay is concerned pertinent to note that the learned Judge while passing the order dated 15/2/2023 in paragraph no. 12 has already noted the conduct of the Investigating Officer and directed appropriate action to be initiated. Hence the two prayers are rejected.
