Learned Counsel for the applicant submits that the case is committed to the Court of Sessions, however, till today charge has not been framed. The applicant is in custody since 5th April, 2014. Taking into consideration over all view of the facts and circumstances of the case, this Court was not inclined to grant bail at this stage. Talwalkar 1/2
13.ba787.15.sxw In view of this, the learned Counsel for the applicant seeks liberty to withdraw the application with further liberty to renew the prayer before the Sessions Court.
The liberty as prayed for is granted. The application stands dismissed as withdrawn with liberty to renew the prayer before the Sessions Court after 6 months. The learned Sessions Court shall consider said application on its own merits without being influenced by withdrawal of this application in this Court. The application is disposed of accordingly.
